The Licensing Act (Scotland) 2005 brought with it radical changes. Operators must ensure they hold the new licence before 1st September 2009 when all transition licences will come into force.
- The date for your Premises Licence renewal is dictated by the quarterly session at which you are due to renew. So if it’s any future March session it’s March 2008, June is June 2008 etc., through to the last applications in January 2009. If you miss that date you run the risk of not actually getting a licence.
- The old training courses, such
as the BII Scottish Licensees Certificate (SLC), cannot be accepted by the board when granting a Personal Licence.
- The 2005 Act overhauled the 1976 legislation; any premises where alcohol is sold on or off sale must hold a premises licence.
- The Act simplified, modernised and reformed legislation and introduced a number of objectives aimed to provide the basis for refusals and grants of new licenses:
- Prevent crime and disorder
- Secure public safety
- Prevent public nuisance
- Protect children from harm
- Protect and improve public health
This means a dual system of licensing, personal and premises licences, will be a requirement for any individual wishing to sell alcohol from 1st September 2009.
- Personal Licence
- will authorise a person aged 18 years or over to sell, authorise or supervise the sale of alcohol on licensed premises
- Personal Licence Holder Training
- is a prerequisite for any personal licence and designated Premises Manager application – it is a statutory requirement to produce evidence of the successful completion of a SQA accredited qualification to the designated specification
